Welcome to the website of Forrester Group Real Estate, led by Damian Forrester, REALTOR^®, and brokered by eXp Realty (collectively, “Forrester Group,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of forrestergrouprealestate.com and any related pages, forms, booking tools, or communications (collectively, the “Site”).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Us

Forrester Group Real Estate is a Montana-based real estate team serving Billings and communities throughout Montana. Real estate brokerage services are provided through eXp Realty, a licensed real estate brokerage. All licensed agents associated with our team operate under eXp Realty in accordance with applicable Montana real estate law and the rules of the Montana Board of Realty Regulation.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use this Site. By using the Site, you represent that you meet these requirements.

3. No Agency Relationship from Site Use

A formal real estate agency relationship is established only through a written representation agreement signed by both you and a licensed agent. Until such an agreement is executed, no agent owes you the duties of representation under Montana law.

4. Real Estate Information & Listings

Property listings, prices, photos, square footage, descriptions, school information, taxes, and other details displayed on the Site or on linked third-party portals (including the eXp listing portal at damianforrester.expportal.com) are provided for general informational purposes only and are sourced from the Multiple Listing Service (MLS), public records, and third parties.

• Listing information is not guaranteed to be accurate, complete, or current.
• All measurements, lot sizes, and square footage are approximate and should be independently verified.
• Properties may be withdrawn, sold, or have changes in price without notice.
• Buyers should independently confirm all material facts with a licensed inspector, appraiser, attorney, or other qualified professional.

Forrester Group makes no representation or warranty regarding the condition, suitability, or value of any property displayed on the Site.

5. Fair Housing & Equal Opportunity

8. Booking & Appointments

If you book a consultation, showing, or appointment through the Site, you agree to provide accurate information and to attend the scheduled appointment or provide reasonable notice of cancellation. Appointments are subject to agent availability and may be rescheduled at our discretion.

9. Third-Party Links & Services

The Site may contain links to third-party websites and services, including but not limited to the eXp Realty listing portal, social media platforms (Facebook, Instagram, TikTok), MLS data providers, mortgage lenders, inspectors, and other service providers. 10. Intellectual Property

All content on the Site — including text, graphics, logos, photographs, videos, agent biographies, the Forrester Group name and logo, and the eXp Realty name and logo — is the property of Forrester Group, eXp Realty, or their respective licensors, and is protected by copyright, trademark, and other intellectual property laws.

You may view and print pages from the Site for your personal, non-commercial use only. Any other use, including reproduction, modification, distribution, or republication, requires prior written permission.

11. User Submissions

Any information you submit through the Site (such as forms, messages, or testimonials) is not considered confidential. By submitting content, you grant Forrester Group a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content in connection with our business, subject to our Privacy Policy.

15. Privacy

16. Modifications

17. Governing Law & Venue

These Terms are governed by the laws of the State of Montana, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Yellowstone County, Montana, and you consent to the personal jurisdiction of those courts.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
